Problem 3: Sharing Technical Data & Intangible Supply

This is where the complexities increase, especially with the DTCA amendments:

Sharing with SLS (US): The sharing of design specifications and technical data via email, secure portals, and video conferencing constitutes an "intangible supply" of DSGL technology. Similar to the physical goods, the AUKUS licence-free environment applies here. OI's engineers can share this data with SLS engineers, provided both companies are registered as AUKUS authorised users and the transfer meets the criteria (e.g., recipient is a US citizen or permanent resident or a US corporation, and the supply occurs at a place in the US).

Sharing with UniSpace (Australia): This is a critical point introduced by the DTCA Amendment Act 2024. From 1 March 2025, it became an offence to supply DSGL technology to a "non-exempt foreign person within Australia" without a permit (Section 10A the "deemed export" or "onshore supply" offence). OI must ensure that any UniSpace researchers involved in the collaboration who are foreign nationals, and not exempt (e.g., covered by the AUKUS exemption if they are US or UK citizens or permanent residents working for a registered entity), have the necessary permits. OI and UniSpace implement strict protocols to identify the nationality of researchers accessing the DSGL technology and apply for permits where necessary. They also confirm if the "fundamental research" exemption applies to any aspects of their collaboration.
